What Happens After Your DUI Arrest?

Thorough Investigation

After retaining us to represent you, we will request the discovery from the prosecutor and begin scheduling court dates.  The discovery includes the police reports and the blood/breath test results.  Once we process the discovery, we will schedule an appointment with you to review everything together. We look at things like why you were stopped by law enforcement and if it was a legal traffic stop, the results of the field sobriety/roadside tests, the blood or breath test results, and your prior traffic and criminal histories. We discuss the possible penalties associated with DUI's, as well as your options and expectations.

Driver's License Suspension

After you are arrested on suspicion of a DUI or, if your BAC (blood alcohol content) was over a .08, you face the possibility losing your driver's license for a specific period of time. If this is your first DUI/DWAI offense, your are entitled to a restricted driver's license after a 30-day revocation, so long as you have an ignition interlock device installed in your car and you meet other Colorado Department of Motor Vehicle requirements. We discuss the driver's license consequences at the initial consultation.

Hearings and Trial

After formal DUI charges have been filed, there will be court hearings scheduled in your case. We represent our clients at each and every one of these hearings. If it is in your best interest, we also negotiate with the district attorney to discuss a possible plea agreement.
